Trikhal Tourism all policies are may not be subjected to effective for 'LAST MINUTE BOOKINGS". Bookings for any services & products or something extra added after booking less then 72 hours of actual Tour start date or specific schedule time.

Trikhal Tourism  like to suggest honestly for avoiding "LAST MINUTE BOOKINGS" due to last moment high cost fluctuations including poor service quality which also directly affects our brand reputation for future. 

1. Booking your Holiday

a) Your contract in respect of your holiday is made with Trikhal Tourism (‘the Company‘), registered in Kolkata, India and all bookings are subject to these terms and conditions.

b) All communications by the Company in relation to your holiday will be sent to the address stated on the booking form.

c) All bookings must be made through an authorised representative of the Company. At the time of booking the Company booking form must be completed and submitted together with a deposit of 50% of the total cost of the booking.

d) Receipt of the deposit and booking form by the Company does neither guarantee nor imply confirmation of the booking. No booking shall be confirmed until the Company issues a booking confirmation notes after receiving advance booking amount. The Company reserves the right to refuse a booking without giving any reason and shall in that event full return any deposit received.

e) Your holiday must be paid in full at least 30 days before the departure date. If payment is not received by the due date, the Company reserves the right to cancel the booking and retain the deposit. The person who signs the booking form guarantees payment of the total amount shown on the booking form in accordance with these conditions. It is the responsibility of the signatory to ensure the Company receives payment in full by the due date. No reminders will be sent.

f) If you book within 30 days of your departure date payment must be made in full at the time of booking.

g) All special requests, such as dietary requirements, should be noted on the booking form.

h) The Company will provide the service as set out and confirmed in writing at the time of booking confirmation.

2. Price Policy

a) The Company is under no obligation to furnish a breakdown of the costs involved in a holiday.

b) The Company reserves the right to notify you of any increase in price before accepting your booking and before giving booking confirmation.

c) After a Confirmation Invoice has been issued, unless you choose to pay for your holiday in full at the time of booking, the price of your holiday is subject to the possibilities of surcharges in certain limited circumstances. However, a surcharge will only be levied to allow for variations in transportation cost, including cost of fuel, increase in normal published airfares, taxes or fees chargeable for services such as landing taxes at airports, the exchange rate applied to the particular package or if the government or regulatory body introduce an increase of taxes. Even then, the Company will absorb an amount equal to 2% of your holiday price (excluding insurance premiums and amendment charges) before passing on any surcharge to you. Only amounts in excess of this 2% will be surcharged. Surcharges will be notified by a revised Confirmation Invoice sent to you.

d) If a surcharge would increase the total holiday price shown on your original Confirmation Invoice by 10% or more, you may cancel your booking within 14 days of the date of issue of the revised Invoice and obtain a full refund of all payments made to the Company and any amendment charges previously incurred.

e) Optionally, you may choose to pay for your holiday in full at the time of booking, in which case your holiday price will be fixed at the cost quoted by the Company at the time. To qualify for this benefit you should return the Confirmation Invoice to the Company with full payment to reach the Company within 7 days of the date printed on the Confirmation Invoice.

f) The financial commitments offered above by the Company mean that the Company is not able to reduce the holiday prices should the value of the Indian Rupee strengthen.

3. Cancellation and Changes by the Company

a) Occasionally it may be deemed necessary to make changes to your holiday and the Company reserves the right to do so at any time, and you will be notified of any changes at the earliest possible opportunity. If a major change to your tour is necessary, providing it does not arise from circumstances beyond the Company’s control, you may choose (i) to accept the change of arrangements (ii) to purchase another holiday from us or (iii) to cancel your holiday. Compensation may be payable in cases of major change as detailed below.

b) No compensation will be payable for minor changes. Minor changes include minimal changes to departure and arrival times, changes to the type of cab used and restaurant and accommodation changes to a comparable or superior standard.

c) Major changes include cancellation, changes to your landing  airports within northeast, delays in departure or return by more than 12 hours and accommodation changes to an inferior standard of accommodation.

d) Compensation will not be paid for changes or cancellations caused by Acts of God (Force Majeure), war, threat of war, riot, civil strike, industrial dispute, terrorist activity, natural or man-made disaster, fire, technical problems to transport, closure or congestion of airports, strikes or other industrial action, adverse weather conditions or any other event beyond the Company’s control. It is essential that you take out adequate travel insurance.

e) The Company reserve the right to cancel your holiday at any time before the date of departure, even after a confirmation notice has been sent. If your holiday is cancelled the Company will refund in full the money you have already paid. No compensation will be payable.

f) Transportation is subject to the conditions of carriage of the carrier, some of which may limit or exclude liability. These conditions are often the subject of international agreement between countries and copies of the conditions, which apply to your holiday journey, will normally be found on the carrier’s tickets.

g) If you fail to pay the balance of the holiday price at least 30 days before departure, the Company will treat the booking as cancelled and levy the cancellation charges set out below

h) The company also has the right to refuse any person as a member of the tour, if in their opinion that person could endanger the health, safety and enjoyment of others on the tour. In any of the events mentioned above, the company’s sole liability and the client’s sole remedy will be limited to a refund of any monies paid, less the amount for services already utilised plus administrative fees.

4. Cancellation and Changes by You

a) You may cancel your holiday at any time providing you notify the Company in writing. The following charges will be levied on any cancellation:

  • 10 days from booking date 20% of deposit.
  • 30 days or more 50% of Deposit
  • 15 – 30 days 100% of Deposit
  • 8 – 15 days 80% of Tour Cost
  • 1 – 7 days 100% of Tour Cost

b) After the itinerary is confirmed, the client is permitted free of administration charges one set of amendments, though will be liable for any added cost this may add to the tour, including airline charges, hotels etc. Any further modifications, which are instigated by the client, will incur a charge of 1000 Rs Indian Money due to communication and administration expenses that may have incurred.

5. Our Responsibilities

a) The Company does not own or manage the cab, accommodation, restaurants and other facilities used in conjunction with the tours arranged. While the Company has exercised care in selecting providers of travel, accommodation, restaurants and other facilities, the Company have not had the opportunity to inspect and do not represent that such cab, accommodation, restaurants, and other facilities and services have been inspected.

b) The Company is not responsible if you or any member of your party suffer death, illness or injury as a result of any failure to perform or improper performance of any part of our contract with you where such failure is attributable to (i) the acts and/or omissions of any member of the party, or (ii) those of a third party not connected with the provision of your holiday, or (iii) an event which neither the Company or the service provider could have foreseen or prevented even with due care.

c) Should any member of your party suffer illness, injury or death through misadventure arising out of an activity, which does not form part of the holiday the Company has arranged for you the Company cannot accept liability. The Company will offer general assistance where appropriate.

d) The Company regret that no refund will be made on unused products where travel, sporting event or other types of ticket, unless a refund can be obtained from the carrier or provider.

6. Your Responsibilities

a) You are responsible for arranging your own travel insurance, though an appropriate policy can be incorporated into your tour package. Details of all insurance policies held by each member of your party must be provided on the booking form. No booking forms can be accepted without sufficient proof that personal policies have been arranged. Please ensure that your insurance cover applies to the specific activities you are booking and which are confirmed on the Confirmation Invoice.

b) Each member of the party must have a valid passport, visas and all necessary documentation for the foreign tourists  with a options of Aadhar card/voter Card for domestic tourists. The Company accept no responsibility for any delay or expense should your documents not be in order.ILp is mandatory for Arunachal and Nagaland .

c) You are responsible for checking-in for cabs at the correct time and for presenting yourself to take up all pre-booked components of your holiday. The Company cannot accept responsibility for clients missing flights as a result of late check-ins and no credit or refunds will be given if you fail to take up any component of your holiday. No credit of refunds will be given for lost, mislaid or destroyed travel documents.

d) By booking a holiday with the Company you undertake to behave in an orderly manner and not to disrupt the enjoyment of others on holiday with you nor to do anything to bring the reputation of the Company into disrepute. If you breach this clause your holiday will be terminated with immediate effect and the Company will have no further contractual obligation to you. The Company will be entitled to recover from the offending party and/or the person who signed the booking form compensation for any damage caused.

e) It is the responsibility of the person who signs the Booking Form to disclose any pre-existing medical conditions that members of their party may have.

f) All equipment and personal effects shall be all times and in all circumstances at the owner’s risk. The Company cannot accept responsibility for any loss or damage or delay to your luggage or effects unless directly caused by the negligence of one of our representatives.

7. Smoking

The Company forbids smoking in any vehicle operated by the Company. Frequent stops can be arranged for those who desire to smoke. All accommodation will be reserved with non-smoking rooms, unless the client specifically requires a smoking room. Confirmation is depending on hotel availability.

8. Waiver

The Company will undertake to ensure the safety of the client throughout the tour, however aspects of each particular tour may not be without an element of danger. Clients should be prepared to sign a ‘Waiver of Responsibility’ form before they begin their tour. This form is an understanding that all clients need to exercise judgement and care at all times to ensure their own safety and that of their fellow tourists.

9. Disclaimer

The Company has made all reasonable efforts to check the accuracy of the information contained in our website. The Company cannot however accept any responsibility for any errors or omissions that may appear in this site.

10. Complaints

a) If you have a problem during your holiday, please inform the relevant driver, hotel, local agent of other suppliers immediately so that they can endeavour to put things right. If you cannot resolve the problems, you must contact the Company office so that they are given an opportunity to help. The Company will not hold themselves responsible for the non-performance of an itinerary through causes beyond their control or when they are not notified of a problem at the point where remedial action can be taken. In the unlikely event that a complaint cannot be resolved at the time, your should write to the Company within 28 days of returning home, giving your original booking reference number and all other relevant information. If you fail to take any of these steps you will hinder the Company’s ability to put any problem right and/or investigate it fully and any right you have to receive compensation will be reduced or completely invalidated.

b) Any dispute that may arise will be governed by Indian law and both parties shall submit to the jurisdiction of the Indian Courts.

c) All information given by the Company whether in writing or orally is to the best of the Company’s knowledge and believed correct at the time given and is given in good faith. The booking conditions shall take precedence over any other warranty or condition that may have been given.

11. Data Protection Act

It may be necessary for the Company to ask you for certain personal information. Examples of this would be dietary requirements, disability/medical or religious information etc. This information will be kept confidential by the Company and is available to you to inspect during the Company’s normal working hours. It will be passed to the suppliers, if it is necessary for them to know this information in order to fulfill the Company’s contract to you.

Trikhal Tourism understands that privacy is important to you and wants your experience when dealing with us to be as enjoyable and safe as possible. This policy describes who Trikhal Tourism is and how it handles your personal information generally as well as when you use our website.

• from a group coordinator who is arranging your travel ( If this is the case we request from the group leader that every member of the group has consented to them providing this Personal Information to us, in order for us to provide those products and services).

As a travel agent, Trikhal Tourism offers products and services on behalf of a number of other providers including but not limited to cruise lines and insurance companies. Travel the World maybe required to disclose your Personal Information to these providers to enable them to provide you with their services and to assist in making your experience a satisfying one. As these providers require this Personal Information when making your booking, if it is not provided we will not be able to finalise your booking.

We want to collect, use and disclose your personal information to keep you up to date with the range of products and services available from Trikhal Tourism and which we think may be of interest to you. If you would like to request access to the personal information we hold about you please contact us by using the relevant Access or Correction contact in the Trikhal Tourism Privacy Contact Information details, which can be found below as we may be able to provide you this information within our normal business processes. If not, the staff member will be able to commence the privacy access request process for you which may require you to complete a privacy access request form. If you are not satisfied with the outcome of the business review you can request the complaint be referred to the Senior Management Team for review or you can contact them directly. Should additional information be required from you, we will contact you to discuss. The Senior Management Team will usually contact you with a decision within 25 business days of receiving your complaint. Step 3. Seek review by an external service
We expect our procedures will deal fairly and promptly with your complaint. However, if you remain dissatisfied, you may be able to access the services of an External Dispute Resolution Scheme such as Indian Consumer Court under Travel Agent laws.

LIMITATION OF LIAIBILITY

My Tour Package and its employees, officers, subsidiaries, affiliates, agents, and assigns does not own or operate any unit which offers, or is to offer, goods or services for tour including lodging facilities, cab owner, food service providers or equipment suppliers, etc.

My Tour Package's responsibility is absolutely limited. We are not responsible for the acts or failures to act, willfully or otherwise, of actual service provider or other third party over whom we do not have any direct control. As tour consultants/ travel agent, we promote, organize and sell tour packages of various tour operators/ service providers/promoted by respected hotel/homestays/cab owners, which may consist of transportation, excursions and accommodations. Such service providers/ tour operators are independent contractors outside our administrative control.

My Tour Package is not liable for any bodily injury or harm, accidents, property damage or personal loss to the clients as a result of, but not limited to –

  1. Physical exertion for which the client may not be prepared.
  2. Transportation by plane, train car, bus, boat or other mode of transportation (such as bicycle, horse, foot, etc.)
  3. Consumption of alcoholic beverages
  4. High altitude on hills
  5. Forces of nature like high winds, hurricanes, flooding, etc.
  6. Exhaustion due to heat.
  7. Civil unrest or terrorism.
  8. Quality of medical services in remote areas.
  9. My Tour Package is further not liable for any expenses like meals, transportation, hotel costs, etc. that are not specifically included in the price of the tour. For any such expenses, if the same is included in price, the actual service provider / tour operator will be responsible.
  10. My Tour Package reserves the right to make alterations in hotel or route of trip in order to improve the quality of a tour or in interest of better accommodation of guests.
  11. My Tour Package is in no way ever responsible for damage to personal belongings of client including electronic goods during tour. This includes but is not limited to damage in water, accidents, loss, and theft.
  12. The maximum liability on part of My Tour Package arising under any circumstances, in respect of any services offered, shall be limited to total amount received from the client. Any consequential loss, damage or additional expense whatsoever will never be part of our liability.
  13. ASSUMPTION OF ALL RISKS BY CLIENT

Clients and user of this website acknowledge that they have voluntarily desired to explore the website and applied voluntarily to participate in the tour designed therein with the knowledge of various risks which includes but not limited to the numerous risks and dangers involved including but not limited to –

  24. Problem associated with lost or misplaced luggage.
  25. RELEASE OF LIABILITY

Client / user of this website acknowledge that the enjoyment and excitement of tour is derived from the inherent risks incurred therein and activity beyond the safety of normal life at home and that such inherent risks contribute to excitement & enjoyment. Therefore, the client agrees to be responsible for their own welfare and associated risks during tour.
  27. Client / user of this website discharge and release My Tour Package from and against all sort of liabilities arising during intended tour except that arise due to negligence of My Tour Package.
  28. Client / user of this website further agree that this release of liability shall be legally binding upon them personally, all family members and minors traveling with them and their heirs, successors, assigns & legal representatives.
  29. My Tour Package reserves the right to increase the tour price without any prior information in the event of increase in cost due to changes in airfares, railway fares, currency fluctuations, fuel prices, etc.
  30. My Tour Package reserves the right to decline to accept or retain any person as a member of specific tour group or to cancel or modify the tour schedule / group without notice.
  31. Client/ user of this website understand that medical services or facilities may not be readily and easily available or accessible during entire tour.
  32. Clients/ users of this website has been advised to have travel insurance, cancellation insurance and medical insurance and the same are the sole responsibility of the person intending to incur tour. They will further be responsible for –
  33. Being in sufficiently good health to undertake the tour.
  34. To prepare themselves for the tour by studying the itinerary and pre-departure materials
  35. For bringing the appropriate clothing and equipment as advised from time to time.

My Tour Package reserves the right to take photograph or film records of any of tour booked by them and to use any such photograph or film records for promotional and/or commercial purposes, including use by third parties with hom My Tour Package may engage in joint marketing. For such photograph or film, the client, who travels, will not be remunerated. The client assigns to My Tour Package all right, title and interest that he/ she may have in or to any media during the tour.
  37. The client/ user of this website understands that My Tour Package reserves the right to refuse anyone as a tour participant, or remove anyone from a tour if it judges them to be incapable of meeting the rigors and requirements of participating in the activities of tour, or who it determines to detract from the enjoyment of the tour by others.
  38. The client/ user of this website will have to follow all written and verbal rules of safety presented to them by the service providers.
  39. My Tour Package reserves the right to make route, hotel and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests.
  40. COMPLAINTS
  41. If any client or user of this website have any grievance in respect of services provided by My Tour Package, the same can be notified to us within 7 days of availing the service.
